Programme Terms & Conditions

These Terms & Conditions apply to all participants booking a place on the Professional Qualification in the Business of Art.

By booking a place and making payment through the Ogilvie Business School website, you agree to these Terms & Conditions.

The Ogilvie Business School is a trading division of Ogilvie Advisory Ltd, registered in Scotland, company number SC540042.

1. Booking and Enrolment

1.1 Places are limited and allocated on a first-come, first-served basis.

1.2 Your place is reserved once the required payment has been successfully made through the Ogilvie Business School website.

1.3 Following booking, you will be asked to complete a Participant Information Form so that programme records, joining information and any relevant participant requirements can be prepared.

1.4 The Ogilvie Business School reserves the right to decline or cancel an enrolment where it reasonably believes the programme is not appropriate for the participant. Where the Ogilvie Business School cancels an enrolment under this clause, any programme fees already paid will be refunded.

2. Programme Fees and Payment Options

All prices below include VAT at the prevailing UK rate.

Participants may choose one of the following payment options when booking.

Pay in Full

The programme fee is:

£2,950 including VAT

The full programme fee is payable through the Ogilvie Business School website at the time of booking, subject to any deposit facility specifically made available through the booking system.

Where a deposit facility is offered for bookings made before the published payment deadline, the outstanding balance must be paid in accordance with the payment schedule displayed at checkout.

All outstanding Pay in Full balances must be settled by 31 August 2026.

Bookings made after 31 August 2026 require payment of the full £2,950 including VAT at the time of booking.

Pay in Instalments

The instalment payment option is:

£3,150 including VAT

This price includes an administration charge for spreading the programme fee over a number of payments.

The payment schedule is:

  • £750 including VAT payable at the time of booking

  • Six monthly payments of £400 including VAT

Payments will be collected automatically in accordance with the payment schedule confirmed at checkout.

By selecting the instalment option, you are committing to payment of the full £3,150 programme fee, subject to the cancellation and refund provisions set out in these Terms & Conditions.

The instalment plan is a payment arrangement for the complete programme and does not constitute a monthly subscription or a pay-as-you-attend arrangement.

3. Payment Terms

Payments made through the website will be processed using the payment methods available at checkout.

Where a participant selects the instalment payment option, subsequent payments will be collected automatically in accordance with the payment schedule confirmed when booking.

Participants are responsible for ensuring that valid payment details are maintained throughout the payment period.

If a scheduled payment fails, the participant should arrange payment of the outstanding amount as soon as reasonably possible.

Persistent failure to make payments when due may result in:

  • suspension of access to programme materials;

  • suspension from teaching sessions;

  • withholding of assessment results;

  • refusal to permit progression through the programme; and/or

  • withholding of the qualification certificate until all outstanding balances have been settled.

Participation in the programme does not remove the obligation to complete the agreed payment schedule.

Participants remain responsible for payment where an employer, sponsor or other third party has agreed to fund the programme unless otherwise agreed in writing by the Ogilvie Business School.

4. Cancellation, Withdrawal and Refunds

We understand that circumstances can change. Participants wishing to cancel or withdraw from the programme should notify the Ogilvie Business School in writing as soon as possible.

Statutory Cancellation Rights

Where you book the programme online as a consumer, you may have a statutory right to cancel your contract within 14 days of booking.

Nothing within these Terms & Conditions affects any statutory rights you may have under UK consumer law.

Where you ask the Ogilvie Business School to begin providing services during a statutory cancellation period, any refund entitlement may be adjusted where permitted by law to reflect services already provided.

Cancellation More Than 28 Days Before the Programme Starts

Where cancellation takes place more than 28 days before the programme start date, payments already made will be refunded, less £250 including VAT, which will be retained to cover the administration of the booking and cancellation, subject always to any applicable statutory cancellation rights.

Cancellation Between 14 and 28 Days Before the Programme Starts

Where cancellation takes place between 14 and 28 days before the programme start date, the Ogilvie Business School will refund amounts already paid less:

  • £250 including VAT to cover the administration of the booking and cancellation; and

  • any reasonable non-recoverable costs already incurred specifically in connection with the participant's place.

Cancellation Less Than 14 Days Before the Programme Starts

Where cancellation takes place less than 14 days before the programme start date, refunds will be considered on a case-by-case basis, taking into account costs already committed and whether the participant's place can reasonably be filled.

Withdrawal After the Programme Has Started

Once the programme has commenced, programme fees are generally non-refundable, and participants who have selected the instalment payment option remain liable for the outstanding programme fee.

Where exceptional circumstances arise, such as serious illness or another significant unforeseen event, the Ogilvie Business School may consider a partial refund, deferral or transfer to a future cohort.

Any such arrangement will be considered individually and remains at the discretion of the Ogilvie Business School, subject to applicable consumer law.

Our intention is to reach a fair and reasonable outcome where genuinely exceptional circumstances arise.

Deferrals

Requests to defer participation to a future cohort must be made in writing.

Where a suitable future cohort is available, the Ogilvie Business School will make reasonable efforts to accommodate the request.

Deferrals cannot be guaranteed and may be subject to an administration charge or additional programme fees where costs or programme prices have changed.

5. Cancellation or Significant Changes by the Ogilvie Business School

If the Ogilvie Business School cancels the programme before it begins, programme fees paid will be refunded in full.

The Ogilvie Business School will not be responsible for travel, accommodation or other consequential costs incurred by participants, except where liability cannot legally be excluded.

6. Attendance

Participants are expected to attend all scheduled teaching sessions.

A minimum attendance level of 85% is required to be eligible for the award of the Professional Qualification in the Business of Art.

If illness or exceptional circumstances prevent attendance, participants should notify the Ogilvie Business School as soon as reasonably possible.

Where appropriate and practicable, reasonable arrangements will be considered to help participants catch up with missed learning. Alternative arrangements cannot be guaranteed.

7. Assessment and Qualification Requirements

To be eligible for the award of the Professional Qualification in the Business of Art, participants must successfully complete the programme requirements, including:

  • a minimum of 85% attendance at scheduled classes;

  • all required practical assignments;

  • the Professional Business Plan; and

  • the Professional Business Showcase.

Assessment and assignment deadlines must be met unless an extension or alternative arrangement has been approved by the Ogilvie Business School.

Payment of programme fees does not in itself guarantee the award of the qualification.

8. Professional Conduct

Participants are expected to behave professionally and respectfully towards fellow participants, guest speakers, venue staff and representatives of the Ogilvie Business School.

The Ogilvie Business School reserves the right to remove a participant from the programme where behaviour is seriously or persistently disruptive, discriminatory, threatening, abusive or otherwise inappropriate.

Where removal results from serious misconduct, programme fees will not normally be refunded, subject to applicable law.

9. Programme Materials and Intellectual Property

All programme materials supplied by the Ogilvie Business School remain its intellectual property unless otherwise stated.

Programme materials are provided for participants' own learning and business development.

They may not be copied, reproduced, distributed, published, recorded, sold, licensed or used to deliver training or other commercial services without prior written permission from the Ogilvie Business School.

10. Photography and Recording

Participants may not photograph, video or audio-record teaching sessions without prior permission.

The Ogilvie Business School may occasionally take photographs or video during programme activities, events, the Professional Business Showcase or graduation.

Where images are intended for promotional use, participants will be informed. Participants who do not wish to appear in promotional photography or video should notify the Ogilvie Business School.

11. Confidentiality

Teaching sessions and group discussions may involve real businesses, commercial challenges, creative ideas and professional experiences.

Participants agree to respect the confidentiality of information shared by fellow participants, guest speakers and the Ogilvie Business School.

Commercially sensitive or confidential information disclosed during the programme must not be shared outside the learning environment without the permission of the individual or organisation concerned.

Participants are responsible for ensuring that they have authority to use any third-party business information included within their assignments.

The Ogilvie Business School will treat confidential information submitted as part of programme assessments appropriately and will not disclose it to third parties except where required by law, necessary for legitimate programme administration or assessment, or with the participant's permission.

12. Programme Changes

The Ogilvie Business School reserves the right to make reasonable changes to:

  • programme dates;

  • venues;

  • guest speakers;

  • teaching order;

  • teaching methods; and

  • programme content.

Changes will only be made where reasonably necessary and will not materially reduce the overall educational content or purpose of the qualification.

Equivalent alternatives will be provided where appropriate.

13. Venue

Teaching will take place at professional venues within Dundee.

Venue details and joining instructions will be provided to participants before the relevant teaching sessions.

The Ogilvie Business School may use different venues during the academic year.

14. Accessibility and Reasonable Adjustments

Participants who require reasonable adjustments are encouraged to notify the Ogilvie Business School as early as possible so that appropriate arrangements can be considered.

The Ogilvie Business School will make reasonable efforts to accommodate accessibility requirements in accordance with applicable law.

15. Participant Businesses, Creative Work and Assessment Work

Participants retain ownership of their businesses, brands, business ideas, artwork, designs, products, services and other original creative work developed during the programme.

Participants also retain ownership of original work produced for programme assessments.

By submitting assessment work, participants grant the Ogilvie Business School a non-exclusive licence to retain copies where reasonably required for assessment, quality assurance and programme records.

The Ogilvie Business School will not publish or use a participant's original creative work or assessment work for marketing or other external purposes without appropriate permission.

16. Business Outcomes

The programme is designed to provide practical education, guidance and support to help participants establish and develop commercially sustainable creative businesses.

However, business performance depends on many factors outside the control of the Ogilvie Business School.

Participation in the programme does not guarantee any particular level of revenue, profit, sales, customers, funding, employment or other commercial outcome.

Participants remain responsible for decisions relating to their own businesses and for obtaining appropriate professional advice where required.

17. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.

Subject to this, and to the fullest extent permitted by law, the Ogilvie Business School will not be responsible for indirect or consequential losses arising from participation in the programme or from business decisions made by participants.

18. Data Protection

Personal information will be processed in accordance with the Ogilvie Business School Privacy Policy and applicable UK data protection legislation.

Information may be used for programme administration, assessment, participant communication, record keeping and other purposes reasonably necessary to deliver the programme.

19. Governing Law

These Terms & Conditions are governed by the laws of Scotland.

Any dispute arising from these Terms & Conditions will be subject to the jurisdiction of the Scottish courts, subject to any statutory rights a consumer may have regarding jurisdiction.

Participant Declaration

By booking a place on the Professional Qualification in the Business of Art, participants confirm that:

  • the information they provide is accurate;

  • they have read and agree to these Programme Terms & Conditions;

  • they understand the total cost and payment obligations associated with their chosen payment option;

  • where they select the instalment plan, they understand that they are committing to the full programme fee of £3,150 including VAT, rather than purchasing the programme on a month-to-month basis;

  • they understand the attendance and assessment requirements for the qualification;

  • they understand that successful completion of the required programme components is necessary to receive the Professional Qualification in the Business of Art; and

  • they acknowledge that their personal information will be processed in accordance with the Ogilvie Business School Privacy Policy.
